Terms of Service

1. Who we are and what these terms cover

Estimake (the "Service") is operated by Cytec BG Ltd., a company registered in Bulgaria under UIC (ЕИК) 202835086, VAT BG202835086, with its registered address at zh.k. Trakia, block 327, entrance V, floor 7, apartment 20, Plovdiv, Bulgaria ("Estimake", "we", "us"). Estimake is our trading name; the company you are contracting with is Cytec BG Ltd. These Terms of Service govern your access to and use of the Service at https://estimake.it, whether on a free plan, a trial, or a paid subscription.

By creating an account or using the Service you agree to these terms, and your continued use of the Service means you continue to agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to bind that company, and "you" means that company.

2. Your account

  1. You must provide accurate registration information and keep your credentials confidential. You are responsible for activity that occurs under your account.
  2. Estimake is organised into workspaces. The workspace owner controls its subscription, members and data, and may add or remove members at any time.
  3. You must be at least 16 years old, or the age of digital consent in your country.

3. Plans, trials and subscriptions

  1. Subscriptions are sold per workspace, not per user, and are billed monthly or annually in advance depending on the plan you choose.
  2. New workspaces receive a 14-day free trial of the Studio plan. No payment details are required for the trial. When the trial ends the workspace moves to the Free plan automatically unless you have subscribed — we will not charge you because a trial expired.
  3. Free and trial workspaces are subject to plan limits (such as the number of active estimates or members) described on our pricing page. Limits may change for new customers, but we will not reduce the limits of your existing paid plan during a period you have already paid for.
  4. Subscriptions renew automatically at the end of each billing period at the then-current price for your plan, until cancelled. We will give you at least 30 days' notice by email before any price increase takes effect for your subscription, and you may cancel before it applies.
  5. Upgrades take effect immediately and are charged pro rata. Downgrades take effect at the end of the current billing period.

4. Payment and merchant of record

  1. Our order process is conducted by our online reseller Paddle.com . Paddle.com is the Merchant of Record for all our orders and handles all customer service enquiries relating to payments, invoices and refunds. Paddle's Checkout Buyer Terms and Conditions apply to the transaction itself, alongside these terms and our refund and payment policy.
  2. Prices are shown excluding VAT or sales tax unless stated otherwise. Paddle calculates and applies the tax due for your location at checkout, and issues a compliant invoice for every payment. Business customers in the EU with a valid VAT identification number may be reverse-charged.
  3. If a payment fails, we will retry it over a short period and notify you. If payment cannot be collected, the workspace moves to the Free plan; your data is not deleted.

5. Cancellation and refunds

  1. You may cancel your subscription at any time from your workspace billing settings or through the Paddle billing portal. Cancellation takes effect at the end of the period you have already paid for; you keep access until then, and you are not charged again.
  2. We refund any subscription payment in full if you ask within 30 days of that payment — monthly or annual, first payment or renewal, and you do not need to give a reason. After 30 days you can cancel and keep access to the end of the period you have paid for, and we will still consider a refund of the unused remainder if you ask.
  3. Consumers in the EU and UK also have a statutory right to withdraw from a purchase within 14 days. Because the Service is supplied digitally and immediately, by subscribing you ask us to begin supply at once and acknowledge that this statutory right ends once supply has begun. Our 30-day refund above is offered in addition to that right, not instead of it.
  4. To request a refund, go to paddle.net, our merchant of record's buyer portal, or email us at support@estimake.it and we will arrange it. Our full refund and payment policy sets out the detail.
  5. We do not charge any cancellation or exit fee.

6. Your data and content

  1. Your estimates, customers, projects and related content are yours. You retain all rights to them. We claim no ownership over the content you put into Estimake.
  2. You grant us a limited licence to host, store, transmit, display and back up your content strictly as needed to operate and support the Service for you.
  3. You can export your estimates at any time in spreadsheet formats, and in PDF on paid plans. If you cancel or downgrade, your content is not deleted — access to some features may be limited by your plan, but your data remains available for export.
  4. We may delete the data of accounts that have been closed, or that have been inactive for more than 24 months, after giving you notice by email and a reasonable opportunity to export.
  5. Where we process personal data on your behalf, we do so as a processor under your instructions. Our Privacy Policy explains what we collect and why. Business customers may request a Data Processing Agreement.
  6. Estimates shared through a share link are accessible by anyone holding the link, unless you protect them with a password. You are responsible for deciding what to share and with whom.

7. Acceptable use and our intellectual property

Our Acceptable Use Policy forms part of these terms and sets out in full what you may and may not do with the Service. In summary, you agree not to:

  1. use the Service in breach of any applicable law, or to infringe anyone's rights;
  2. use the Service for fraud, or to send unsolicited bulk email, phishing or other spam;
  3. upload or transmit malicious code, attempt to gain unauthorised access to the Service, other accounts, or the systems and networks that support it, or probe, scan, scrape, overload or disrupt it, or circumvent any plan limit, rate limit or access control;
  4. resell, sublicense or make the Service available to third parties as a service of your own, except by using it to prepare estimates for your own clients as intended;
  5. store or distribute unlawful or abusive material through the Service.

We own the Service and everything in it that is not your content — the software, its interfaces, documentation, and the Estimake name and branding. Your subscription grants you a limited, non-exclusive, non-transferable right to use the Service while it is active, and transfers no ownership of any of that to you.

8. Service availability and changes

  1. We aim to keep the Service available continuously, but we do not guarantee uninterrupted access. Maintenance, updates and factors outside our control can cause downtime.
  2. We continue to develop the Service and may add, change or remove features. We will not make a change that materially reduces the core functionality of a paid plan during a period you have already paid for without offering you a pro-rata refund.
  3. If we discontinue the Service entirely, we will give you at least 90 days' notice, a pro-rata refund of any prepaid unused period, and the means to export your data.

9. Warranties and disclaimer

We provide the Service with reasonable care and skill. Beyond that, and to the extent permitted by law, the Service is provided "as is" without further warranties of any kind, whether express or implied, including implied warranties of merchantability or fitness for a particular purpose.

Estimake is a tool for preparing estimates; it does not decide what your work is worth. You are responsible for the figures, assumptions and commitments in the estimates you produce and send, and for any contract you enter into on the basis of them.

Nothing in these terms limits your statutory rights as a consumer, which are unaffected.

10. Limitation of liability

  1. Neither party excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
  2. Subject to (a), our total liability to you arising out of or in connection with the Service in any 12-month period is limited to the amounts you paid us for the Service in that period, or €100 if you are on a free plan.
  3. Subject to (a), we are not liable for indirect or consequential loss, loss of profit, revenue, business, goodwill, or contracts not won.

11. Suspension and termination

You may stop using the Service and close your account at any time.

We may suspend or terminate your access to the Service where:

  1. you materially breach these terms or our Acceptable Use Policy;
  2. you repeatedly or seriously breach them, having been asked to stop;
  3. a payment due for your subscription is not made and cannot be collected after we have retried and notified you;
  4. there is a security or fraud risk to the Service, to other users, or to us — including suspected unauthorised access to your account;
  5. we are required to by law, or we discontinue the Service under clause 8(c).

Where circumstances allow, we will warn you first and give you a reasonable opportunity to put things right. We reserve immediate suspension for cases where waiting would cause harm. You keep the right to export your data unless the law prevents us from allowing it, and on termination clauses 6, 9, 10 and 12 survive.

12. Governing law and disputes

These terms are governed by the laws of Bulgaria, and the courts of Bulgaria have jurisdiction. If you are a consumer resident in the EU, you keep the protection of the mandatory laws of your country of residence and may bring proceedings there. The European Commission's Online Dispute Resolution platform is also available to consumers.

13. Changes to these terms

We may update these terms. If a change materially affects your rights we will notify you by email or in the application at least 30 days before it takes effect, and you may cancel before then if you do not agree. The date at the top of this page shows when it was last revised.
